Volunteering Terms and Conditions

By creating, hosting, or participating in a volunteering opportunity on Tersia, you agree to the following terms and conditions. Please read them carefully, as they constitute a legally binding agreement between you and Tersia.

1. General Terms

  1. Eligibility: You must be at least 18 years old, or have parental/guardian consent if under 18, to participate in or organize volunteering opportunities.
  2. Compliance: You agree to comply with all Tersia policies, these terms, and all applicable local, state, national, and international laws and regulations.

2. Organizers

  1. Organizer Responsibilities: Organizers are solely responsible for providing accurate opportunity information, managing applications, and ensuring compliance with all applicable laws and regulations. Organizers must take reasonable steps to ensure the safety and well-being of all volunteers and beneficiaries.
  2. Vulnerable Populations: If your volunteering opportunity involves children, elderly, or other vulnerable populations, you must comply with all safeguarding laws and best practices, including background checks, training, and supervision as required by law.
  3. Content Standards: Opportunities must not contain or promote illegal, discriminatory, or inappropriate content. Tersia reserves the right to remove any opportunity that violates these standards at its sole discretion.
  4. Privacy: Organizers must respect the privacy of volunteers and beneficiaries and only use their information for opportunity-related purposes. Sharing or selling volunteer information is strictly prohibited.
  5. Indemnification: Organizers agree to indemnify and hold harmless Tersia, its affiliates, and its service providers from any claims, damages, or liabilities arising from their opportunities or conduct.
  6. Insurance and Legal Compliance: Organizers are responsible for ensuring appropriate insurance coverage and compliance with all legal requirements for their volunteering activities.
  7. Platform Fees on Donations: All donations collected through the platform are subject to a 5% processing fee, which will be deducted automatically from your payouts.
    Fee Modification by Agreement: Notwithstanding the foregoing, any separate written agreement regarding platform fees, duly executed by an authorized representative of the organization and Tersia, shall supersede the fee provisions stated herein.

3. Volunteers

  1. Application and Participation: Volunteers must provide accurate information during application and agree to comply with all organizer instructions, codes of conduct, and applicable laws.
  2. Safeguarding: Volunteers working with vulnerable populations may be required to undergo background checks or provide references as a condition of participation.
  3. Assumption of Risk: By participating in a volunteering opportunity, you acknowledge and accept all risks associated with participation, including but not limited to personal injury, illness, or property damage.
  4. Code of Conduct: Volunteers must behave respectfully and professionally, and must not engage in any form of harassment, discrimination, or abuse.
  5. Privacy: Volunteers must respect the privacy and dignity of beneficiaries and other volunteers.
  6. No Employment Relationship: Participation in volunteering opportunities does not create an employment, partnership, or agency relationship with Tersia or the organizer.

4. Limitation of Liability

  1. No Warranty: Tersia provides its platform and services "as is" and makes no warranties, express or implied, regarding the quality, safety, legality, or conduct of any opportunity, organizer, or volunteer.
  2. Limitation of Liability: To the maximum extent permitted by law, Tersia is not liable for any direct, indirect, incidental, special, or consequential damages arising from or related to your use of the platform or participation in any volunteering opportunity.

5. Miscellaneous

  1. Modification of Terms: Tersia reserves the right to modify these terms at any time. Continued use of the platform constitutes acceptance of the updated terms.
  2. Governing Law: These terms are governed by the laws of the jurisdiction in which Tersia operates, without regard to conflict of law principles.
  3. Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
