Event Terms and Conditions

Effective Date: 15 February, 2025

By creating, hosting, or participating in an event on Tersia, you agree to the following terms and conditions. Please read them carefully, as they constitute a legally binding agreement between you and Tersia.

1. General Terms

  1. Eligibility: You must be at least 18 years old and capable of entering into legally binding contracts to use Tersia for organizing or attending events.
  2. Compliance: You agree to comply with all Tersia policies, these terms, and all applicable local, state, national, and international laws and regulations.

2. Event Organizers

  1. Organizer Responsibilities: Organizers are solely responsible for providing accurate event information, managing registrations, and ensuring the event complies with all applicable laws and regulations. Organizers must take reasonable steps to ensure the safety and well-being of all attendees.
  2. Content Standards: Events must not contain or promote illegal, discriminatory, or inappropriate content. Tersia reserves the right to remove any event that violates these standards at its sole discretion.
  3. Platform Fees: By creating a paid event, you agree to a 10% platform fee on all ticket sales (inclusive of all Stripe and processing fees), which will be deducted automatically from payouts.
    Fee Modification by Agreement: Notwithstanding the foregoing, any separate written agreement regarding platform fees, duly executed by an authorized representative of the organizer and Tersia, shall supersede the fee provisions stated herein.
  4. Payments and Payouts: All payments are processed via Stripe. Payouts to organizers are typically available within 7 days after the event has concluded, subject to Stripe's processing times and compliance checks. Delays may occur due to Stripe's risk and compliance reviews or incomplete account information.
  5. Changes and Cancellations: If your event details change or the event is cancelled, you must promptly notify all registered participants and process any applicable refunds in accordance with these terms.
  6. Privacy: Organizers must respect the privacy of participants and only use their information for event-related purposes. Sharing or selling attendee information is strictly prohibited.
  7. Indemnification: Organizers agree to indemnify and hold harmless Tersia, its affiliates, and its service providers from any claims, damages, or liabilities arising from their events or conduct.

3. Attendees

  1. Ticket Purchases: All ticket purchases are subject to availability and the organizer's event policies.
  2. Refund Policy: Attendees are eligible for a full refund if a refund request is made more than 72 hours before the event start time. Refunds requested within 72 hours of the event start time may not be honored, except in cases of event cancellation or at the organizer's discretion.
  3. Refund Processing: Approved refunds will be processed via Stripe and may take up to 7 business days to appear in your account, depending on your bank and Stripe's processing times.
  4. Event Changes and Cancellations: If an event is cancelled or materially changed, attendees will be notified and may be eligible for a refund in accordance with this policy.
  5. Code of Conduct: Attendees must behave respectfully and comply with all event rules and instructions from organizers. Tersia reserves the right to remove attendees who violate these terms or disrupt events.
  6. Assumption of Risk: By attending an event, you acknowledge and accept all risks associated with participation, including but not limited to personal injury, illness, or property damage.

4. Limitation of Liability

  1. No Warranty: Tersia provides its platform and services "as is" and makes no warranties, express or implied, regarding the quality, safety, legality, or conduct of any event or user.
  2. Limitation of Liability: To the maximum extent permitted by law, Tersia is not liable for any direct, indirect, incidental, special, or consequential damages arising from or related to your use of the platform or participation in any event.

5. Miscellaneous

  1. Modification of Terms: Tersia reserves the right to modify these terms at any time. Continued use of the platform constitutes acceptance of the updated terms.
  2. Governing Law: These terms are governed by the laws of the jurisdiction in which Tersia operates, without regard to conflict of law principles.
  3. Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
